These Terms of Use (“Terms”) govern your access to and use of the website available at Panovis.com (“Company”, “we”, “our” or “us”), including all webpages, portals, applications, content, materials, information, software, databases, maps, imagery, reports, visualisations and other materials or services made available through or in connection with the website (collectively, the “Website”).

By accessing, browsing or using the Website, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website.

If you are accessing or using the Website on behalf of a company, partnership, governmental authority or other legal entity, you represent and warrant that you are authorised to accept these Terms on its behalf, in which case “you” and “your” shall refer to that entity.

These Terms constitute a legally binding agreement between you and the Company.

  • Eligibility

You represent and warrant that: (a) you have the legal capacity and authority to enter into and be bound by these Terms; (b) where you access or use the Website on behalf of an organisation, you are duly authorised to bind that organisation; (c) all information provided by you through the Website is true, accurate, current and complete; (d) you will use the Website only for lawful purposes and in compliance with all applicable laws and regulations; and (e) your access to and use of the Website does not violate any agreement, obligation or restriction applicable to you.

  • Intellectual Property Rights

All rights, title and interest in and to the Website and all content, materials and technology made available through or in connection with the Website are owned by, licensed to or otherwise lawfully controlled by the Company or its licensors and are protected by applicable intellectual property and other laws. copyrights and copyrightable works; trademarks, service marks, trade names and logos; software, source code and object code; databases and database structures; maps and mapping materials; geospatial datasets and GIS outputs; survey information and survey-derived materials; drone imagery and aerial imagery; orthomosaics; digital twin models; remote sensing outputs; reports and technical documentation; methodologies, processes and know-how; designs, graphics and photographs; and all other proprietary content and materials made available through the Website.

Except for the limited right of access expressly granted under these Terms, no licence, right, title or interest in or to any intellectual property is granted or transferred to you, whether expressly, by implication, estoppel or otherwise. The Company name, logos and other names, marks and identifiers displayed on the Website may constitute trademarks or trade names of the Company, its affiliates or third parties. No right to use any such marks is granted without the prior written consent of the relevant rights holder.

  • Geospatial Content

The Website may contain or display maps, geospatial datasets, coordinates, survey information, drone or aerial imagery, satellite imagery, orthomosaics, digital twin models, remote sensing outputs, spatial analyses, technical reports, visualisations and other geospatial or technical information (collectively, “Geospatial Content”).

Geospatial Content is provided for general informational and business purposes only and may be subject to limitations arising from, among other things: (a) source data, data availability and data quality; (b) accuracy, resolution and precision; (c) collection methodology and equipment; (d) processing, modelling and analytical techniques; (e) assumptions, estimates and interpretations; (f) temporal changes in physical conditions; (g) technical, environmental or operational conditions; and (h) limitations inherent in third-party or publicly available data.

Unless expressly stated otherwise in writing, Geospatial Content should not be relied upon as a substitute for independent surveying, engineering, inspection, legal, regulatory or other professional assessment. Geospatial Content must not be used as the sole basis for navigation, safety-critical activities, engineering or construction decisions, emergency response, regulatory compliance, cadastral determinations, land-title or ownership determinations, boundary determinations or other decisions where inaccurate or incomplete information could result in material loss, damage or injury.

You are responsible for independently verifying the accuracy, suitability and currency of any Geospatial Content before relying upon it for any particular purpose.

  • No Professional Advice

Nothing on the Website constitutes or is intended to constitute legal, engineering, surveying, geospatial, technical, financial, investment, tax, regulatory or other professional advice. Information made available through the Website is provided for general informational purposes and should not be relied upon as a substitute for advice from an appropriately qualified professional. The Company does not assume any duty to provide advice or to update any information following its publication.

  • Third Party Content

The Website may contain or reference content, information, data, products, services or links provided by third parties. The Company does not control and, except as expressly stated otherwise, does not endorse or assume responsibility for any third-party content, websites, applications, products, services, data or materials.
